AGREEMENT TO OUR LEGAL TERMS
We are Individual developer Ivan Zaletaev ("Company," "we," "us," "our"). We operate the website at https://parenyx.com and the mobile application Parenyx (formerly ChildFocus).

These Legal Terms constitute a legally binding agreement made between you and Individual developer Ivan Zaletaev, concerning your access to and use of the Services. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. OUR SERVICES
The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation.
2. INTELLECTUAL PROPERTY RIGHTS
We are the owner or licensee of all intellectual property rights in our Services (the "Content"), as well as the trademarks/service marks/logos (the "Marks"). We grant you a non-exclusive, non-transferable, revocable license to access the Services and download/print Content solely for personal, non-commercial use. No part of the Services/Content/Marks may be copied, reproduced, republished, or exploited commercially without express prior written permission.
Your submissions: by sending us feedback/suggestions, you assign to us all IP rights in such submissions, without acknowledgment or compensation.
3. USER REPRESENTATIONS
By using the Services you represent that: you have legal capacity; you are not a minor in your jurisdiction; you will not access the Services through automated/non-human means; you will not use the Services for any illegal purpose; your use will not violate any applicable law.
4. PROHIBITED ACTIVITIES
You agree not to, among other things: systematically scrape/compile data without permission; defraud or mislead; circumvent security features; harass or harm other users; use automated bots/scrapers; reverse-engineer the software; impersonate another user; use the Services for a competing commercial enterprise.
5. USER GENERATED CONTRIBUTIONS
The Services do not offer users the ability to submit or post content publicly. If contributions are made, the user represents they own or have rights to the content, it is not false/misleading/obscene/illegal, and does not violate third-party rights.
6. CONTRIBUTION LICENSE
We may access, store, process, and use any information and personal data you provide. We do not assert ownership over your contributions — you retain full ownership.
7. SERVICES MANAGEMENT
We reserve the right to monitor the Services for violations, take legal action, restrict/disable content, and otherwise manage the Services to protect our rights.
8. TERM AND TERMINATION
We reserve the right, without notice or liability, to deny access to and use of the Services to any person for any reason, including breach of these Legal Terms.
9. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, suspend, or discontinue the Services at any time without notice, with no liability for any resulting loss.
10. GOVERNING LAW
These Legal Terms are governed by the laws of the Republic of Kazakhstan. Courts of the Republic of Kazakhstan have exclusive jurisdiction — except that consumers habitually resident in the EEA, UK, or Switzerland retain the benefit of mandatory consumer-protection provisions of their country of residence.
11. DISPUTE RESOLUTION
- Informal negotiations first, for at least 30 days.
- EU/EEA/UK/Switzerland consumers: binding arbitration below does not apply — disputes go to the competent courts / consumer-protection rules of the consumer's country of residence, including EU ADR mechanisms.
- Everyone else (binding arbitration): International Commercial Arbitration Court under the European Arbitration Chamber (Belgium, Brussels, Avenue Louise, 146), one arbitrator, seat Brussels, language English, substantive law = Republic of Kazakhstan. No class actions.
- Exceptions (not subject to arbitration): IP disputes, theft/piracy/privacy-invasion claims, injunctive relief claims.
12. CORRECTIONS
We reserve the right to correct errors, inaccuracies, or omissions in the Services' content at any time without prior notice.
13. DISCLAIMER
THE SERVICES ARE PROVIDED "AS-IS" AND "AS-AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. No liability for content errors, personal injury/property damage, unauthorized access, service interruption, bugs/viruses, or third-party content/products.
14. LIMITATIONS OF LIABILITY
Liability is capped at the lesser of (a) amount paid by you in the 12 months prior to the claim, or (b) USD 100 — except where mandatory consumer-protection law (e.g. EEA/UK/Switzerland) grants additional rights that cannot be limited this way.
15. INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from any claim arising from: your use of the Services; breach of these Legal Terms; violation of third-party rights; harmful acts toward other users.
16. USER DATA
We maintain data you transmit for the purpose of managing Services performance. We perform regular backups but are not liable for loss or corruption of data.
17. ELECTRONIC COMMUNICATIONS AND SIGNATURES
Visiting the Services / sending emails / completing forms constitute electronic communications you consent to. For EEA/UK/Switzerland users, electronic signatures are governed by Regulation (EU) No 910/2014 (eIDAS) and applicable national law.
18. MISCELLANEOUS
These Legal Terms constitute the entire agreement. We may assign our rights/obligations at any time. If any provision is unenforceable, it is severable without affecting the rest.
